Terms of Service

Version 1.1 — effective 2026-06-18

SUSCOM is a private compliance platform provided for the exclusive use of officials appointed by FIM Europe. By creating an account or using the platform you agree to these Terms. If you do not agree, do not register or use the Service.

1. Definitions

  • "Service" / "SUSCOM" — the SUSCOM web application available at suscom.app and its related functionality.
  • "FIM Europe" — the European motorcycling federation, Viale delle Arti 181, 00054 Fiumicino (Rome), Italy, for whom the Service is operated.
  • "Operator" — the party that develops, hosts and operates the Service on behalf of FIM Europe.
  • "User" / "you" — an individual appointed by FIM Europe (a Steward, Administrator or Operator) who is granted access to the Service.

2. Eligibility and Accounts

The Service is a closed tool. Registration is restricted to individuals appointed or authorised by FIM Europe. Accounts are not open to the general public; every new account remains pending until approved by an authorised administrator.

You must provide accurate registration information, keep your credentials confidential, and are responsible for all activity under your account. Notify an administrator immediately if you suspect unauthorised access. You must be at least 18 years old.

3. Acceptable Use

You agree to use the Service only for its intended purpose — recording, reviewing and managing FIM Europe sustainability compliance. You must not:

  • access or attempt to access data or accounts that are not yours;
  • submit false, misleading or unlawful information;
  • upload malicious code, or attempt to disrupt, probe, or circumvent security controls;
  • copy, scrape, reverse engineer, decompile, or create derivative works of the Service;
  • share your account, or use the Service to harass others or infringe any third-party rights;
  • enter special-category or criminal-offence personal data. You must not submit, in checklists, messages, uploaded files or any other field, special categories of personal data under Art. 9 GDPR (e.g. data revealing health, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, genetic or biometric data, or data concerning sex life or sexual orientation) or personal data relating to criminal convictions or offences (Art. 10 GDPR). The Service is not designed for and does not collect such data;
  • use the Service in breach of applicable law or FIM Europe regulations.

4. Your Content and Data

Checklists, uploaded maps, messages and other records you create ("Content") are processed on behalf of FIM Europe, which is the data controller for personal data in the Service. You retain responsibility for the accuracy of the Content you submit. You grant the Operator and FIM Europe the right to host, process and store your Content as needed to provide the Service and to meet FIM Europe's compliance and record-keeping obligations.

Do not include special-category or criminal-offence personal data (Art. 9–10 GDPR) in any Content. The Service processes only ordinary personal data (such as names, e-mail addresses, FIM Europe licence numbers, technical logs and checklist content) and is not intended for sensitive data.

The handling of personal data is described in the Privacy Policy, which forms part of these Terms.

5. Intellectual Property

All intellectual property rights in the Service software, design and underlying technology belong to the Operator (or its licensors). You are granted a limited, non-exclusive, non-transferable, revocable right to use the Service for FIM Europe compliance purposes only. No rights in the software are transferred to you. Data and records belong to FIM Europe as set out in Section 4.

6. Availability and Changes

We aim to keep the Service available and reliable, but it is provided without a guarantee of uninterrupted availability. Maintenance, updates or factors beyond our reasonable control may cause temporary unavailability. We may modify, suspend or discontinue features of the Service; material changes affecting Users will be communicated where practicable.

7. Suspension and Termination

An administrator or the Operator may suspend or terminate your account if you breach these Terms, if FIM Europe withdraws your appointment, or as required by law. You may request deletion of your account at any time via Settings, subject to the retention rules in the Privacy Policy (certain compliance records are retained where FIM Europe has a legal obligation to keep them).

8. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose. You are responsible for ensuring that the compliance information you enter is correct; the Service is a tool to support, not replace, your professional judgement and FIM Europe's regulatory requirements.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special or consequential loss, or loss of data, profits or goodwill, arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded by law (including liability for death or personal injury caused by negligence, fraud, or breaches of data-protection law where such limitation is not permitted).

10. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page will be updated, and material changes will be notified to Users. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Slovak Republic, and the competent courts of Slovak Republic shall have exclusive jurisdiction over any dispute.
